Real estate investment is not just about buying a property and waiting for it to appreciate. The taxation on resale in LMNP has changed, the DPE schedule is progressively excluding certain properties from the rental market, and the electricity coefficient recalculates labels without a single euro being spent on renovations. Protecting your real estate assets today requires a technical understanding of these constraints even before signing a preliminary agreement.
Electricity DPE Coefficient and Automatic Reclassification of Properties
The decree of August 13, 2025, published in the Official Journal on August 26, 2025, modifies the electricity conversion coefficient in the DPE calculation. This change can shift some electrically heated properties out of classes F or G, without any physical intervention on the building.
For an investor, this modification has two direct consequences. A property classified as G that moves to F due to the new coefficient temporarily regains the right to be rented, since properties classified as G have been excluded from rental since 2025. However, this reprieve is limited: F properties will also be banned from rental starting in 2028.
The recalculated certificate, as provided by ADEME, must be verified before any acquisition. A property presented as “out of G” due to the new coefficient may seem attractive, but the rental horizon remains constrained by the Climate and Resilience schedule. We recommend systematically cross-referencing the recalculated label with the necessary work program to achieve at least class D before 2034, by which time E properties will also be excluded.
The sheets available on the Guide Patrimoine net website detail the structures suitable for this type of regulatory constraint, particularly for deciding between heavy renovation and early resale.

LMNP Taxation on Resale: The Trap of Article 84
Non-professional furnished rental under the real regime historically allowed for the depreciation of the property while benefiting from a capital gain calculated on the initial purchase price. Article 84 of the finance law for 2025 changes this mechanism.
Now, the deducted depreciations reduce the acquisition price for the calculation of the capital gain. An investor who has depreciated several tens of thousands of euros on a furnished rental property finds themselves with a significantly higher taxable base at the time of sale.
This additional tax cost at resale alters the overall profitability equation of LMNP under the real regime. Before 2025, the real regime was almost systematically recommended for furnished properties. This is no longer the case for investors whose holding horizon is short or medium.
Arbitration Between Real Regime and Micro-BIC
The micro-BIC, with its flat-rate allowance, becomes competitive again in certain cases. The criteria to evaluate:
- The projected amount of depreciations over the intended holding period, relative to the annual tax benefit they provide
- The resale horizon: beyond about fifteen years, the holding period allowance on the capital gain may partially offset the effect of Article 84
- The nature of the property (tourist furnished, student residence, classic lease), each category having its own thresholds and allowances
DPE Schedule and Rental Acquisition Strategy
The Climate and Resilience law of August 22, 2021, sets a progressive schedule for excluding thermal sieves from the rental market. Properties classified as G are already banned from rental. F will follow in 2028, and E in 2034.
Buying an energy-intensive property at a discounted price is only profitable if the renovation budget is calibrated before signing. A property classified as F acquired in 2026 leaves less than two years to achieve at least class E, or it will no longer be legally rentable.
The rental vacancy related to energy renovation work must be included in the profitability calculation. A property left vacant for six to eight months for a complete renovation generates a loss in rental income, ongoing condominium fees, and accruing loan interest.
Rent Control and DPE
In rent-controlled areas, a change in DPE class after renovations does not always allow for raising the rent to market levels. The applicable reference rent remains that of the area, type of rental, and construction period. Energy renovation improves the rental appeal of the property but not necessarily its gross rental profitability in these tight sectors.

Structuring Mortgage Credit to Protect Assets
Credit remains the main lever for real estate investment. The structuring of the loan determines both profitability and asset protection in case of unforeseen events.
A classic amortizable loan over a long term minimizes the monthly payment and increases the deductibility of interest in the context of a rental investment under the real regime. However, with the LMNP reform, this optimization must be recalculated on a case-by-case basis.
- The partial amortization deferral allows covering the renovation period without burdening cash flow during rental vacancy
- The modularity of payment terms (upward or downward) offers flexibility if rental income fluctuates
- Borrower insurance, often overlooked, serves as a direct asset protection tool: in case of death, the property is transferred without debt to the heirs
Delegating borrower insurance reduces the overall cost of credit sometimes significantly compared to the bank’s group contract. Since the Lemoine law, changes can occur at any time.
The debt-to-income ratio remains capped by the HCSF. For an investor already owning their primary residence, the residual borrowing capacity depends on the differential between weighted rental income and existing credit charges. Structuring a first rental investment without saturating this ratio preserves the ability to reinvest.
Heritage real estate relies on technical arbitrations renewed each year by fiscal and regulatory developments. The DPE schedule, the LMNP reform, and credit conditions form a triptych where each component modifies the others. Buying without modeling these interactions means protecting an asset on paper while exposing it in practice.
